Stamp duty and registration in Delhi

In Delhi an agreement under one year is stamped at the bond rate, 2% of the total rent payable for the term. A refundable security deposit is not charged. The ₹100 e-stamp that many brokers use is under-stamped on this reading; it is cheap but leaves the document open to a penalty if it is ever produced in court. Buy an SHCIL e-stamp from an authorised centre and confirm the figure there.

Agreements under 12 months do not need registration. Notarising is common practice but not a legal requirement. For 12 months or more, register at the sub-registrar office: duty of 2% of the average annual rent plus ₹1,000 registration and ₹100 pasting fee.

The Delhi Rent Control Act of 1958 applies only where the rent is ₹3,500 a month or less and the building is more than ten years old, so most agreements today fall outside it and the written agreement governs.

Rates are from public sources as of October 2026 and can change. Confirm the amount with the stamp vendor or sub-registrar office before paying. This page is general information, not legal advice.
